Customer Services Agreement

Between Customer & Banashankari Home Nursing Services

Terms and Conditions:

Hereafter, the term “Company”, “Us”, or “We” refers to Banashankari Home Nursing Services, and the term “Customer”, “Client”, or “Applicant” refers to the individual or entity availing services from the Company.

Registration Fee

15 to 90 days: ₹3,000 (Non-refundable) More than 90 days: ₹6,000 (Non-refundable)

Payment Terms

Cancel within 7 days → Full refund (excluding registration fee) After 7 days → No refund If patient passes away unexpectedly → No refund

Advance Booking

Customers can pre-book service days as per requirement.

Service Cancellation & Refund Policy

Services canceled within 7 days will receive a full refund (excluding registration fee). Services canceled after 7 days are non-refundable. If the patient passes away unexpectedly, no refund will be issued.

Usage of Staff

Customers cannot assign household work beyond duty Customers cannot hire staff directly Violation → Service cancellation without refund

Staff Leave Policy

Staff gets 2 days leave per month Work on leave day → Extra payment required Replacement only if paid separately If staff unavailable → amount refunded

Non-Disclosure Agreement

Customer must not discuss salary/payment with staff.
All discussion must be with company representative.

Security & Responsibility

Customer must check staff before leaving premises Company not responsible for missing valuables Misbehavior must be reported within 24 hours

Staff Safety & Harassment Policy

Any harassment or misconduct towards staff will lead to legal action
 under IPC Sections 354 & 509.

Medical Disclaimer

Staff will work as per doctor’s prescription Company not responsible for allergic reaction / side effects / death

Service Modifications & Charges

Charges may change if service changes.

Legal Provisions

Agreement under: Contract Act 1872 Labour Laws Workmen’s Compensation Act 1923 Torts Law Jurisdiction: Bangalore Court

Inspection & Supervision

Monthly inspection by field officer.

Registration & Service Commencement

After registration, company needs 2 days to provide staff.

Professional Boundaries

Customer must not develop personal relations with staff.
Violation → Warning / termination / no refund / legal action.

Off-Duty Responsibility

Outside working hours → Company not responsible.

Customer Communication

Only customer or authorized person can talk with company.

Labour Law Compliance

Staff entitled to leave as per labour law.

Additional Terms & Conditions:

Only basic nursing care provided Specialized procedures → Doctor responsibility Customer must provide food & accommodation Company can terminate service if rules violated False complaints → Legal action Disputes should be discussed before legal action
Taking photos or videos of clients, doctors, or caregivers without permission is strictly prohibited
Clients and caregivers should not ask or share personal details such as phone numbers, religion, or other private information
